purposes only.
THE TERMS AND CONDITIONS FOR SENDING
PRODUCTS AND MATERIALS FOR REVIEW AND FOR PUBLISHING
REVIEWS OF PRODUCTS AND MATERIALS ARE AS FOLLOWS:
1) These Terms and Conditions are effective
immediately, apply to any and all samples and materials
sent, and override any previous agreements, verbal,
written, or otherwise. We reserve the right to change
these Terms and Conditions at any time and without notice.
2) All samples and materials sent to FlashlightReviews.com
or the author become the property of the author. Samples
and materials sent to FlashlightReviews.com or the author
will NOT be returned to the sender. Requests to have
the samples and materials returned will not be fulfilled.
3) You agree not to charge FlashlightReviews.com or
the author any fees, costs, or other compensatory charges
in exchange for keeping samples and materials sent for
review.
4) Samples and materials sent for review may be damaged
or destroyed in the reviewing process.
5) You agree not to hold FlashlightReviews.com or the
author liable for the cost of samples and materials
that are lost or damaged in the shipping process, either
to or from FlashlightReviews.com.
6) By sending samples and materials for review you
agree to the following:
a) The review will be published on the Internet in
full public view.
b) You take the risk of the review being unfavorable.
You accept the fact that unfavorable reviews will
still be published.
c) You accept the fact that the honest opinions of
the reviewer will be stated in the review.
d) You accept that, although an honest attempt will
be made to accurately represent information about
the product or materials being reviewed, no guarantees
are made as to the accuracy of the information presented
in the review.
e) You agree not to hold FlashlightReviews.com or
the author liable in any way for damages, consequential
or otherwise, that result from your participation
in the review process.
f) Review materials become the property of the author
and will NOT be returned.
7) If you send samples or materials for review that
have already been reviewed on the site, the following
applies:
a) If the author mistakenly told you that the author
had not reviewed the samples or materials, the author
will ship them back to you at the author's cost.
b) If you sent the samples or materials without confirming
that they had not yet been reviewed, the author can
either keep the samples or materials, or ship them
back at your cost. This is your choice.
8) Reviews are generally completed in the order received.
A variety of factors may affect the order of the reviews.
No guarantee is made that they will be completed in
the order received.
9) Demands on the author's time dictate the rate at
which reviews will be completed. No guarantee is made
regarding the time it will take to complete and post
reviews.
10) Review format may vary and include or exclude various
tests, descriptions, and features. No guarantee is made
regarding the format or contents of the review.
BY SENDING SAMPLES OR MATERIALS FOR
REVIEW, YOU AGREE TO ALL OF THE TERMS AND CONDITIONS
LISTED ABOVE.
If you do not agree with any of the above stated terms
or conditions, DO NOT send samples or materials for
review.
GENERAL RECOMMENDATIONS WHEN SENDING
SAMPLES FOR REVIEW:
- If shipping overseas and/or the samples are relatively
inexpensive, I would recommend you send at least two,
in case one fails during testing or is damaged in
shipment. This especially applies if the cost of shipping
exceeds the cost of the unit. You would be surprised
at the number of samples I have received that failed
immediately upon first use.
- I would recommend that you mark the package/invoice
as "Test Samples - No Value" and a monetary
value of "$0.00".
- Package the samples in a larger shipping box with
plenty of padding. Have at least 1" (2.5cm) of
padding space all the way around for cushioning. Using
crumpled newspaper as padding works fine in most cases.
- "Fluid" cushioning materials (foam peanuts,
shredded paper) are not recommended since they can
shift and move to one side in transit and spill out
if the packaging is damaged.
- Seal the box well with wide plastic shipping tape.
Cover all seams and weak areas with tape. Do not use
duct tape or masking tape.
WHY DO I FEEL THE NEED TO ADD THIS POLICY TO MY
SITE?
Two reasons.
First, I want no mistake that when you send a sample
to me for review, you take your chances that the review
may not be as favorable as you wish and it WILL be published
on the Internet in full public view. You must agree
to that risk. You send your stuff and you take your
chances. This is the way it has always been, but I want
to make sure everyone understands it.
Second, I've encountered a number of folks who want
to send me samples for review and then want them back.
Essentially they are reaping the rewards of having the
review of their product published and I have nothing
to show for it. All I ask in return for the reviews
is to keep the sample after the review for continued
evaluation purposes. No more, no less. By being asked
to return samples it makes me feel that some folks are
trying to take advantage of my efforts. This is unacceptable
in my opinion, so samples sent will no longer be returned.
Sorry to have to do this, but I feel it is necessary
based upon current trends.
